We wanted to take this opportunity to remind you that NYC has stepped up its enforcement of Local Law 111 of 2022 (LL 111/2022) which went into effect on April 1, 2023, and amended Subdivision a of Section 16-120 of Chapter 1 of Title 16 of the Administrative Code of the City of New York, as amended by Local Law number 22 for the year 2002.
As amended, LL 111/2022 still requires that “[t]he owner, lessee, agent, occupant or other person who manages or controls a building or dwelling shall provide and maintain… separate receptacles for the deposit of incinerator residue and ashes; refuse, and liquid waste.” In addition, any property that receives two (2) “pest” violations (ECB or HPD) within one (1) year, can be required to put out all garbage in containers of such “material or design approved by the department, department of health and mental hygiene and department of housing preservation and development to minimize rodent access and harborage” for up to two (2) consecutive years without the further issuance of any additional pest violations. Please note that, if any ECB “pest” violations are dismissed at a hearing, or HPD “pest” violations are certified as corrected in a timely manner, such ECB and HPD Violations will not count towards this two (2) year requirement. HPD and/or the New York City Department of Sanitation (DSNY) will notify any property owner if they are required to begin containerizing their trash to comply with the LL 111/2022 two (2) year containerization requirement.
