This week we wanted to remind you that Local Law 97 (LL 97-2019) establishing Carbon emission limits for certain properties went into effect on January 1, 2024. The following types of properties are deemed “Covered Buildings”, and will be regulated by LL 97-2019:
i. Buildings over 25,000 gross square feet
ii. Two or more buildings on the same tax lot that together are over 50,000 gross square feet
iii. Two or more buildings owned by a condo association that are governed by the same board of managers and that exceed 50,000 gross square feet

Starting next year, Covered Buildings must meet increasingly stringent greenhouse gas emission limits or face violations and fines. The stated goal of LL 96-2019 is to reduce the emissions produced by the city’s largest buildings 40 percent by 2030 and 80 percent by 2050. The first annual Local Law 97 compliance reports, which include the total emissions produced in calendar year 2024, are due to the Department of Buildings on May 1, 2025. Property owners should be aware that, in order to meet these new emission limits, certain buildings will be required to undergo energy efficiency retrofits and Owners will have to take all necessary measures to reduce the carbon emissions produced in connection with operating their buildings.
